Appeals court applies Supreme Court ruling to Medtronic lawsuit against Boston Scientific

A federal appeals court today reconsidered a lawsuit between Medtronic and Boston Scientific in light of the U.S. Supreme Court’s decision this year that Boston Scientific bears the burden of proof concerning a patent it licenses from Mirowski Family Ventures.

In January the Supremes ruled unanimously that MFV must prove that Medtronic’s devices are in violation even though Medtronic filed the original challenge against the patent in 2003, while still under a sub-license agreement for the technology. Read more

No women, none over 40: Former employee accuses Minn. medtech firm of hiring bias

Minnesota-based PMT Medical came under fire after a former employee accused leadership of implementing discriminatory hiring practices that excluded women and candidates over the age of 40.

The U.S. Equal Employment Opportunity Commission filed a lawsuit after doing some digging into the allegations and finding out that there were no female sales reps hired at PMT Medical between Jan. 1, 2007, through late in the year in 2010. There were at least 70 men hired during that time, according to a commission report. Read more

Covidien's ev3 seeks new trial in $175M loss to Appriva

Covidien subsidiary ev3 wants the Delaware Supreme Court to grant a new trial in a lawsuit over $175 million ev3 allegedly owes its own Appriva Medical acquisition.

Last summer a jury in the Delaware Superior Court ruled that ev3 broke its contract with Appriva Medical when it denied the $175 million milestone for Appriva’s Plaato device, which it acquired in August 2002 for a $50 million cash payment plus milestones, according to court documents. Read more

Appeals court denies extra fees to BD in test strip row with Abbott

Abbott won’t have to fork over an extra $1.9 million in legal fees rival Becton Dickinson & Co. is seeking in their long-running patent infringement war over blood glucose test strips.

Ten years ago Abbott subsidiary Therasense sued BD and its supplier, Nova Biomedical, in a series of suits that were consolidated in the U.S. District Court for Northern California. BD and Nova Biomedical won a $6 million judgment in late 2008 against Abbott and its Therasense subsidiary. Read more

Jury hits South Korean medical device maker with $25M in trade secret theft case

A South Korean medical device company is on the hook for more than $25 million after a federal jury in Texas found that it misappropriated trade secrets involving cardiac MRI technology from LBDS Holding Co.

LBDS Holding sued ISOL in August 2011, alleging that the South Korean company broke their deal to integrate its cardiac MRI software into ISOL’s existing MRI platform and instead stole the software and used it in its own MRI offering, according to court documents. Read more
